为贯彻落实中央、省委和商务部全面深化改革的决策部署,进一步了解我省商务信用建设现状,制定改革措施和政策。我省信用建设商务field,我处 收集国内外相关信息,举办17个行业协会、7家企业负责人参加的“商务信建讯会”,走访长沙、常德、岳阳等地城市,并询问商务信用建设。向公司调查进行了提问,并征求了市州主管部门商务的书面意见,现将调查结果报告如下:

一、信用建设发展概况

(一)国外信用建设概览

社会信用体系是市场经济体制中的一项重要制度安排。经过一百多年的发展,美国、欧洲、日本等市场经济发达国家已经建立了较为完善的社会信用体系。概括起来,这些国家的社会信用体系建设主要有三种模式:一种是以美国为代表、以私人信用服务为特征的商业模式;二是以德国等欧洲国家为代表,以公共信用服务为特征。三是以日本为代表、以协会信用服务为特征的行业协会模式。三种施工模式的基本条件如下表所示。

(二)全国及外省信用建设基本情况

我国社会信用体系建设经历了一个不断认识、探索、深化和发展的过程,从金融、经济到社会,从地方到社会其他领域,从一个行业到多个行业,从当地发展历史的核心。

首先,本世纪以来,我国以政府部门为主体的信用信息收集和监管体系开始建立。中国人民银行建立了全国联网的企业和个人征信登记咨询系统;国家工商总局建立企业基本信息数据库;海关、税务、建设、质检、食品药品监管、外汇、商务等部门也建立了信用分类管理平台,对交易对手进行管理。

二是逐步加强对信用建设的指导。 2007年,国务院印发了《关于建立社会信用体系的若干意见》。同年,国务院办公厅牵头召开社会信用体系建设部际联席会议第一次会议,落实十项工作中急需推进的工作部署。社会信用体系建设。 2008年,国务院进一步明确中国人民银行承担“管理征信业,推进社会信用体系建设”的职责,率先建立了建立社会信用体系的部际联席会议制度。社会信用体系。联席会议办公室设在中国人民银行。 2011年,党的十七届六中全会将社会信用体系建设扩大到政府诚信、商务诚信、社会诚信和司法公信等领域的信用建设,涵盖经济领域和伦理领域。 2014年1月15日,国务院总理李克强主持召开国务院常务会议,部署加快社会信用体系建设,营造诚实守信的经济社会环境。会议原则通过了《社会信用体系建设规划纲要(2014-2020年)》。 2005年,国家整改办等机构印发了《关于商协会行业信用建设的指导意见》。 2006年,国家整改办等机构印发了《行业信用评价试点工作实施办法》和《关于实施首批行业信用评价试点工作的通知》,启动行业信用评价工作2007年商务部发布了《商务领域信用信息管理办法》,制定了商务信用信息管理规范。2009年商务部发布了《中国行业信用等级以上企业信用评价名录》 A》、2011年商务部门印发《关于“十二五”期间加强商务域信用建设的指导意见》和《关于“十二五”期间电子商务信用体系建设的指导意见》五年”期间。 2012年6月,商务部决定在北京、天津、上海、重庆、青岛、宁波、沉阳、无锡、福州、广州等10个城市开展商务诚信建设试点工作侯。主要内容包括保证产品质量、提高服务质量、坚持诚信经营、树立商业品牌四个方面。

三是政府部门组织开展廉政宣传活动。国家商务部、中宣部等部门每年9月在全国范围内开展“诚信兴旺”宣传月活动。公安部商务部等11部门对虚假促销、零售商侵占供应商货款、服务业违法经营、特许经营欺诈、外贸欺诈、涉外贸易欺诈等六类商业欺诈进行重点整治。劳动合同工程造假等。

各省(市、区)也积极探索本地区社会信用体系建设。上海、浙江、广东、湖南等地社会信用体系建设起步早、进展迅速,在国内率先取得了一些经验。

(三)我省信用建设基本情况

我省信用体系建设于2004年正式启动。到2010年,社会信用体系的组织体系、制度体系、信息体系、中介服务、奖惩机制、宣传教育机制等基本框架基本形成。初步成立。

1、提高组织领导力,形成工作协同。 2004年11月,省政府组织成立“湖南省社会信用体系建设工作领导小组”,分管金融工作的副省长任组长,湖南34个省直、中央单位为成员单位,中国人民银行长沙中心牵头单位。 2012年,省发改委与中国人民银行长沙中心支行共同牵头全省社会信用体系建设。

2、建立标准化体系。一是制定中长期建设规划,明确目标任务。 2004年以来,根据经济社会发展实际和信用体系建设需要,湖南省先后编制了2005-2010年和2011-2015年社会信用体系建设规划。二是出台政策法规,加强制度保障。 2009年省人大常委会印发的《关于大力推进社会信用建设的决议》(省人大决议),成为全国第二部专门针对社会信用体系建设的地方性法规省政府先后印发《关于湖南省信用信息管理办法的决定》(湖南省人民政府令第202号)、《关于加快建立诚信激励和失信惩戒机制的通知》(湘政办函[2007]105号) )、《关于加强信用信息工作促进中小企业健康发展的意见》(向政办发[2010]19号)等制度性政策。

3、建立良好的信用信息基础。一是加大政府信息公开力度,促进信用信息共享。制定了相应的《实施办法》(省人民政府令[2009]245号),建立了考核机制,政府信息公开的责任单位、范围、方式、程序、监督保障内容等。被澄清。省政府设立了专门的政务公开网站。二是建设征信信息交流平台,促进信息分类整合。为湖南37家省中央单位建立了湖南省信用信息交流平台。本平台使用中国人民银行建立的金融信用信息基础数据库、省企业信息化管理局、省公民信息管理局建立的企业信用信息基础数据库。以省政府电子政务外网为重点,建立市民基本信息库(简称“三库”)。自2005年以来,该平台共交换信息超过2100万条。

4、促进信用市场的发展。一是稳步推进征信机构发展,已有两家征信机构申请备案。二是规范和培育信用评级市场,已备案6家信用评级机构。三是大力推进保障体系建设。

5、实施可信赖的激励和不可信赖的惩罚机制。初步建立行政管理领域信用奖惩机制。从政府部门入手,在资质认定、项目评审、评估优先、政府采购、招投标等行政工作中推进信用奖惩落实,逐步扩大奖惩范围,加大奖惩力度。

(四)我省商务系统信用建设情况

2、 做好征信信息收集和应用工作,鼓励守信,惩戒失信。 2010年以来,我司累计收集国内贸易、外贸、外商投资、外经信用信息3万条,上报湖南省社会信用体系建设领导小组“三库一网”。 我司关于我司信用体系建设的政策文件、工作部署、工作进展、工商企业信用信息等,均及时在湖南省商务局公信息网公示发布,指导全省商务系统开展诚信经营示范。创作活动和信用体系建设发挥了重要作用。我省物流与采购联合会、肉类行业协会、拍卖协会、典当协会、外经协会、家政协会、连锁经营协会、外商投资企业协会在审查“诚信经营”示范企业过程中,积极利用信用信息。在查阅工商、税务、银行等部门提供的相关信用信息后,对不良诚信记录实行一票否决,对企业诚信建设起到了引导和教育作用。

3、 积极组织开展“诚信经营”示范创建活动。我系积极组织指导集中管理的学会或协会开展商务Field诚信经营示范创建活动。一是2009年8月成立创客活动领导小组,二是创客活动工作计划(湖南商务秩序)。 〔2010〕5号),三是组织召开多次全省商务领域“诚信经营”示范创建活动工作会议。我司充分发挥行业协会作用,积极推动行业协会在商务领域开展信用建设和“诚信经营”示范活动。 2010年7月,我馆举办了湖南商务田间诚信经营示范活动暨示范企业颁奖典礼。大会授予45家诚信经营示范企业。目前,全省有物流、肉类、拍卖、典当、家政、连锁经营、外经、外商投资等8个行业协会,评选出诚信经营示范企业313家。开展“诚信经营”示范创建活动,对引领企业诚信建设具有重要意义。手术取得了很好的效果。

4、 大力弘扬诚信经商,增强企业和个人诚信意识。为形成浓厚的诚实守信社会氛围,我司高度重视舆论宣传工作。每年3、9月份,组织开展“亿城千店无假货”、打假打假活动和“诚信兴旺宣传月”活动。我司每年下发《湖南商务部关于在全省商务系统实施“廉洁繁荣月”的通知》,并根据实际情况,9月,17省政府省委宣传部等机构联合发布。该单位在全省开展“诚信致富宣传月”活动。经过一个月的“诚信兴业”活动,在全省各部门、各单位的密切配合和共同努力下,全省通过广播、电视、报纸、网络等方式开设专题栏目和专题宣传。在大型流动商业街、城市广场、超市、商场等区域,通过开业典礼、展示宣传板、发放宣传资料、现场咨询等方式开展街道宣传活动。营造了浓厚的宣传氛围,社会反响强烈,效果显着。

5、支持中小企业信用担保和保险,促进商业信用销售发展。近年来,我司大力推动和促进商业信贷销售,积极争取中央财政对中小企业融资担保和信用保险的补贴,开展融资担保和信用保险研究诚信商务调查,制定了具体的融资性担保费补助资金使用管理办法。多次在省内举办中小企业融资担保和信用保险培训班,系统部署全省中小企业融资担保和信用保险补贴。 2009年以来,为114家(二级)担保公司和859家(二级)中小企业提供融资担保补贴4131万元。全省15家内贸企业、4家保险公司的内贸信用保险项目获批资金201万元。

6、完善12312商务举报投诉机制,加大社会监督力度。我省商务系统不断加强举报投诉平台建设,完善举报投诉受理处理机制,充分发挥“12312”商务举报投诉服务热线作用,及时依法受理和处理投诉举报湖南商务信用建设研究报告,为社会公众提供快捷方便的举报、投诉、申诉和咨询渠道。建立健全投诉举报奖励制度,鼓励社会公众举报工商部门各类失信行为。举报投诉服务中心功能垂直推进省市州县区联网12312商务举报投诉服务,从定点屠宰、酒类、成品油、家电等重点领域横向拓展下乡、家电以旧换新、报废汽车、再生资源、典当、拍卖、特许经营、“万村千镇工程”、家政等领域的举报投诉咨询服务服务等,实现一网多用,充分履行商务市场监管职责。目前,全省12个市州开通了12312举报投诉服务热线,全省共设立举报投诉服务中心64个12312个。 2009年至2013年,全省共受理投诉5613件,咨询12691件。

二、商务信用建设中的问题

(一)不可信的行为时有发生

总体来说,我省商务信用状况较好,但仍存在失信违规现象。这主要表现在市场上公开售卖假冒伪劣产品的现象比上一时期大大减少。 商务合同履约率较高,商业企业担保贷款合同违约率较低。但是,不同行业、不同地区、不同公司的诚信度极不平衡。高值耐用品的可信度高,低值易耗品的可信度低。大型商业企业的信誉度较高,而中小企业,特别是小企业和个体工商户的信誉度较低。 例如,一些食品店或小超市出售假酒,专业市场的一些经营者出售假冒伪劣商品等不诚实现象,农贸市场存在短缺或出售不合格猪肉。从地区来看,城市商务诚信度高,农村尤其是偏远农村商务诚信度低,主要表现为假冒伪劣商品泛滥,售后服务不完善。原因是农村地区分布广泛,监管难度大。 , 农村人口受教育程度、商品知识和维权意识较低。

(二)信用体系建设相关法律法规亟待完善

目前,国家层面与社会信用体系建设相关的法律法规尚不完善,严重制约了社会信用体系建设的进程。一是征信系统建设的法律体系不系统深圳靠谱私家侦探 ,水平不高。以法规为依据,缺乏统一性;二是缺乏信用信息应用等重要法律法规。社会信用体系建设相关法律法规的缺失和不足,也直接制约了商务信用体系的发展。

(四)商务信用信息数据收集、共享和应用有待加强

我省虽然建立了37个省级部门互联互通的“三库一网”信息平台,但征信信息采集仍不完整,部分地方和部门未采集我省有价值的征信信息。在数据库中。由于人员有限、资金不足、相关制度不完善等限制,商务各级部门缺乏专人负责征信信息的征集和报送,直接影响征信信息征集的数量和质量,尤其是对于企业失信行为负面信息的征集更是有限。信息化应用不强。部分政府部门、企业和个人尚未形成信用信息使用习惯,导致信用信息应用程度有限,对规范经营活动影响不大。

(五)信用行为奖惩机制和措施有待加强

守信激励措施和失信惩戒措施尚未实施。部分政府部门信用信息查询和申请较少,在日常监管、行政许可、资质管理、表彰评价、财政补贴资金安排、政府采购、招投标等方面对信用记录的参考不足,导致企业和个人的信用记录参考不足。对信用状况的约束不足。一些地方和部门出于当地利益、害怕负面影响、侵犯隐私等因素,对失信经营者和黑名单的曝光不够。

(六)诚信文化建设有待加强

廉洁文化宣传教育缺乏完整性、系统性和综合性。很多企业和个人对信用法律法规和知识缺乏了解,不知道如何获取和使用信用信息。

(七)信贷产品和服务的使用需要扩大

我国的信用产品开发和服务还很不完善。商业信贷产品和信贷工具相对较少,应用不广泛。国内信用保险和信用消费刚刚起步,民间信用中介服务机构发展缓慢。

(八)商会协会与企业开展商务信用建设需推进

从调查的部分行业和公司来看,企业信用管理并不完善。大多数企业没有建立信用管理工作机制,没有专职人员收集贸易伙伴信用档案,对客户信用风险缺乏系统、科学的研究。

(九)电子商务信用建设迫在眉睫

目前,我国电子商务已进入快速发展时期,但由于网络空间的广泛性和虚拟性,信用缺失已成为制约电子商务进一步发展的主要瓶颈。目前,我国信用体系建设尚处于起步阶段。电子商务信用管理系统不健全。大多数公司没有信用管理部门。他们在交易前缺乏调查 的客户信息,也缺乏对客户的适当信用状况。据电子商务了解,贸易伙伴选择错误导致违约。

三、促进信用建设的建议

(一)对国家和省级信用建设工作的建议
